Terms of Service

These Terms of Service ("Terms") govern your use of the DashClean mobile application ("the App") provided by DashClean Team ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Service Description

DashClean is a photo management and cleaning tool for iOS that provides the following features:

• Photo Analysis: Scan your photo library to identify duplicate photos, similar photos, similar screenshots, and similar videos.
• Photo & Video Compression: Reduce file sizes of images and videos on your device.
• Cleaning Tools: Review and delete unwanted photos and videos with a built-in trash/recycle bin.
• Privacy Vault: A PIN or Face ID protected space to store private photos and videos separately from your main library.
• Calendar View: Browse your media organized by date.
• Live Photo Tools: Split live photos into separate still image and video components.

All photo analysis and processing is performed locally on your device. Your photos are not uploaded to our servers.

2. Subscription Terms

2.1 Free and Premium Features

The App offers both free and premium features. Some features require an active subscription to access.

2.2 Subscription Plans

• Weekly Plan: $9.99 per week
• Yearly Plan: $34.99 per year

Prices are in USD and may vary by region. The actual price displayed in the App at the time of purchase applies.

2.3 Billing

• All subscriptions are billed through your Apple App Store account.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.

2.4 Cancellation

• You can cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions).
• Cancellation takes effect at the end of the current billing period. You retain access to premium features until then.
• We do not process refunds directly. Refund requests are handled by Apple per their refund policy.

2.5 Restoring Purchases

If you reinstall the App or switch devices, you can restore your subscription by using the "Restore" feature within the App. This verifies your purchase with the App Store.

3. Acceptable Use

When using the App, you agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Attempt to bypass or circumvent subscription verification or any access controls.
• Interfere with or disrupt the App's functionality or our backend services.
• Use automated tools, bots, or scripts to interact with the App.

4. Your Content

4.1 Photo Library

You retain full ownership of all photos, videos, and media in your device's photo library. The App processes your media locally on your device and does not claim any rights to your content.

4.2 Privacy Vault

Files stored in the Privacy Vault are saved within the App's local sandbox on your device. Please note:

• Privacy Vault contents are not backed up to iCloud or our servers.
• If you delete the App, all Privacy Vault contents will be permanently deleted.
• We cannot recover Privacy Vault files or PINs. You are responsible for remembering your PIN.

5. Intellectual Property

The App, including its design, code, graphics, and user interface, is owned by DashClean Team and protected by applicable intellectual property laws. Your subscription grants you a personal, non-exclusive, non-transferable, revocable license to use the App on your personal devices.

6. Disclaimers

6.1 Service Availability

The App is provided "as is" and "as available." We aim to provide a reliable experience but do not guarantee uninterrupted or error-free operation. Maintenance, updates, or service disruptions may occur.

6.2 Photo Deletion

6.3 Compression

Photo and video compression reduces file sizes, which may result in reduced quality. The App shows estimated sizes before compression. Results may vary depending on the original file format and content. We recommend keeping original copies of important media before compressing.

6.4 Analysis Accuracy

The duplicate and similar photo detection algorithms use heuristic analysis. Results may not be perfect in all cases. Some photos may be incorrectly grouped, and some duplicates may not be detected. Always review suggested items before deleting.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
• Our total aggregate liability is limited to the amount you paid for the App in the 12 months preceding the claim.
• We are not responsible for data loss resulting from photo deletion, compression, or Privacy Vault data loss due to app uninstallation.

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including liability for gross negligence or intentional misconduct.

8. Indemnification

You agree to indemnify and hold harmless DashClean Team from claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

9. Changes to the App

• We may update, modify, or discontinue features of the App at any time.
• Subscription pricing changes will not affect your current billing period. New prices apply upon renewal after notice.
• We will make reasonable efforts to notify you of significant changes through the App or App Store update notes.

10. Termination

• You may stop using the App and delete it at any time.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your license to use the App ends. Your locally stored data remains on your device until you delete the App.
• Active subscriptions should be canceled through Apple to avoid continued billing.

11. Third-Party Services

The App relies on certain third-party services:

• Apple App Store: For distribution, subscription billing, and purchase management. Apple's terms apply to all purchases.
• Apple Photos Framework: For accessing and managing your photo library. Subject to iOS permissions.
• Firebase (Google): For crash reporting and push notifications.

We are not responsible for the availability, accuracy, or practices of third-party services.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and notify you through the App where feasible. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you disagree with updated Terms, please stop using the App and cancel any active subscription.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which DashClean Team is established, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation first. If negotiation fails, disputes may be submitted to the competent courts of the applicable jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
